These Terms and Conditions form a legally binding agreement between the property owner (“the Owner”) and the person making the booking (“the Lead Guest”). By confirming a booking, the Lead Guest agrees to these Terms on behalf of all members of the party.


1. Booking & Payment

1.1 A booking is confirmed once the required deposit has been received and written confirmation has been issued.
1.2 A non-refundable deposit of 25% is payable at the time of booking.
1.3 The balance must be paid no later than 31 days before arrival.
1.4 If the balance is not received by the due date, the Owner reserves the right to cancel the booking and retain the deposit.
1.5 Bookings made within 31 days of arrival require full payment at the time of booking.


2. Cancellation Policy

2.1 All cancellations must be made in writing by the Lead Guest.
2.2 The following cancellation terms apply:

  • More than 31 days before arrival – deposit retained
  • Less than 31 days before arrival – 100% of total booking retained

2.3 No refunds will be given for early departure.
2.4 Guests are strongly advised to obtain appropriate travel insurance.
2.5 The Owner reserves the right to cancel a booking due to circumstances beyond their control. In such cases, payments made will be refunded in full, and the Owner’s liability shall be limited to the amount paid.


 

 

4. Maximum Occupancy & Visitors

4.1 The maximum occupancy of the property is Bramble Brae 8 persons and Balgownie Bunkhouse 12 persons, in accordance with licensing conditions.
4.2 Only guests named on the booking may stay overnight.
4.3 Visitors are permitted only with prior written consent and must not exceed the maximum occupancy limit at any time.
4.4 Parties, events, or gatherings are strictly prohibited unless agreed in writing.
4.5 Breach of this clause may result in immediate termination of the booking without refund.


5. Check-In & Check-Out

5.1 Check-in is from 3 pm.
5.2 Check-out is by 10 am.
5.3 The property must be left in a clean and tidy condition.
5.4 Excessive cleaning may incur additional charges.


6. Use of Property

6.1 The property is let solely for holiday purposes.
6.2 No commercial activities or subletting are permitted.
6.3 Guests must respect neighbours and the rural setting at all times.
6.4 Quiet hours apply between 10:00pm and 8:00am.


7. Wood-Burning Stove

7.1 The wood-burning stove is used entirely at the guest’s own risk.
7.2 Guests must follow the operating instructions provided in the property.
7.3 Only authorised fuel may be used. Burning rubbish or inappropriate materials is strictly prohibited.
7.4 The stove must not be left unattended while in operation.
7.5 Children must be supervised at all times when the stove is lit.
7.6 Any damage resulting from misuse will be charged to the Lead Guest.

Tampering with carbon monoxide alarms, smoke alarms, or fire safety equipment is strictly prohibited and may result in immediate termination of the stay.


8. Fire Safety

8.1 The property complies with Scottish fire safety requirements for short-term lets.
8.2 Fire exits must remain unobstructed at all times.
8.3 Candles, fireworks, and indoor open flames (other than the stove) are prohibited unless agreed in writing.
8.4 BBQs must be used safely and never left unattended.


9. Rural Location & Access

9.1 The property is located in a rural area. Access roads may be narrow, single track, or uneven.
9.2 During winter conditions, guests are responsible for ensuring their vehicle is suitable for travel.
9.3 The Owner accepts no liability for travel disruption caused by weather or road conditions.
9.4 The grounds may contain uneven surfaces, slopes, natural water features, livestock, or wildlife. Children must be supervised at all times.
9.5 Mobile phone reception and WiFi connectivity may be limited due to the rural location.


10. Utilities & Services

10.1 The properties operate on septic tank drainage, oil heating, or similar rural systems.
10.2 Only toilet paper may be flushed. Wipes, sanitary products, nappies, and other items must be disposed of in bins.
10.3 Guests will be responsible for call-out charges resulting from misuse.
10.4 While every effort is made to ensure uninterrupted services, the Owner cannot guarantee continuous supply of electricity, water, heating, or internet access. No refunds will be given for temporary outages beyond the Owner’s control.


11. Pets

11.1 Well behaved pets are permitted only if agreed in advance at a cost of £20 per pet.
11.2 Pets must not be left unattended in the property unless crated and only for a short time.
11.3 Pets are not permitted on furniture or in bedrooms.
11.4 Guests are responsible for cleaning up after pets – including the garden area.
11.5 Any damage caused by pets will be charged.


12. Smoking & Vaping

12.1 Smoking and vaping are strictly prohibited inside the property.
12.2 Evidence of smoking indoors will result in additional cleaning charges.


13. Damage & Breakages

13.1 Guests must report any damage or breakages as soon as possible.
13.2 Guests are liable for the cost of repair or replacement for damage beyond normal wear and tear.


14. Complaints

14.1 Any issue must be reported immediately during the stay to allow the Owner an opportunity to resolve it.
14.2 Complaints raised after departure will not be considered if the Owner was not given the opportunity to rectify the matter.


15. Liability

15.1 Guests occupy the property at their own risk.
15.2 The Owner accepts no liability for loss, theft, or damage to personal belongings.
15.3 The Owner shall not be liable for personal injury unless caused by proven negligence.


16. Force Majeure

The Owner shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to severe weather, natural disaster, government restrictions, utility failure, or acts of God.


17. Scottish Short-Term Let Compliance

The property operates in accordance with the Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) Order 2022. Guests agree to comply with all safety instructions and occupancy limits in accordance with licence conditions.


18. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
